Ex-trustee ejected by Bombay HC, Parsi Punchayet elections mandated

There was a lot of courtroom drama as a bench of Justices S J Kathawalla and Milind Jadhav heard the interim applications filed by sitting trustees Kersi Randeria, Armaity Rustom Tirandaz, and others, in the legal battle over the pending elections. The Bombay high court ordered that elections for all seven trustee positions of the Bombay Parsi Punchayet (BPP) Trust will be held on Sunday, May 29, 2022. Dinshaw Mehta, a former chairperson of the Trust, and one Farhanaz (Farah) Irani had to be led out of the courtroom by police officers stationed outside. The bench stated in its order that it “strongly deprecates the conduct” of Mehta, a trustee for 21 years, and Irani, who “appeared to be accompanying him” in disturbing court proceedings. The proceedings before the HC were to determine the schedule for the elections. The court stated that Dinshaw Mehta, the father of current trustee Viraf Mehta, “started disturbing the court by reiterating his objections to the scheme” when discussions with the trustees’ attorneys got underway. The HC order stated, “On 2-3 occasions, we requested Dinshaw Mehta not to disturb the court proceedings.” He claimed that as an intervenor in the dispute, he ought to be heard. He was informed by the court that his intervention application relates to objections to the proposed scheme for the election of trustees of the Funds and Immovable Properties of the Parsi Punchayet of Bombayâand that his intervention application therefore came to an end, said the HC, informing him that he had no right to disturb the court when the cour Mehta responded by continuing to act in this way needlessly by saying that he is aware of the court’s authority. The court reminded him once more that, despite having the authority to order his departure, it would prefer not to do so. The court will have to order Mr. Dinshaw Mehta’s removal from the courtroom if he does not control himself, it was made clear to him, according to the HC order, which also stated that he ‘continued to disturb’ and was joined by the woman who ‘appeared to be accompanying’ him. All parties were requested to leave at once by the HC, and only their attorneys were allowed to stay.
